This is a question we are getting asked more and more, if my current tenants have a periodic tenancy, with the changes coming into place on the 15th July 2022, will I still need to give them six months notice?
Good news! The answer is NO.
Whilst the assured shorthold tenancy will automatically convert to an occupation contract, and the tenant convert to a contract-holder, the notice period served on a periodic tenancy/contract will remain just two months whilst the tenancy/contract remains periodic.
With the current legislation written into the Renting Homes Act (Wales) 2016, it is stipulated that if the current fixed term tenancy/contract, becomes periodic after the 15th of July 2022, then the notice period required will become six months.
What notice will I need to serve?
With Section 21 Notices being scarped on the 15th of July 2022, if you are serving notice before this date, you can still use the Section 21 Notice.
If you are looking to serve notice after the 15th of July 2022, on a periodic tenancy/contract, you would need to use the new notice, which is a Section 173. Remembering that the notice period is currently 2 months for a converted periodic agreement/contract, and 6 months for an agreement/contract that becomes periodic after the 15th of July 2022.
